On September 25, SMM9, the Law of the people's Republic of China on the Prevention and Control of Environmental pollution by solid waste was formally implemented.
Where is the "new" of the new solid waste law?
1. The solid waste Law defines the establishment of an extended producer responsibility system for electrical and electronic products, lead-acid batteries, vehicle power batteries and other products, strengthening excessive packaging, plastic pollution control, sludge treatment, laboratory solid waste management and other basic requirements.
two。 Whoever engages in the collection, storage, utilization or disposal of hazardous waste without a permit shall be ordered by the competent department of ecological environment to make corrections and impose a fine of not less than 1 million yuan but not more than 5 million yuan, and shall be ordered to suspend business or close down with the approval of the people's government with the power of approval.
3. The new solid waste Law stipulates that legal representatives, principal responsible persons, persons directly in charge and other responsible persons who engage in the collection, storage, utilization and disposal of hazardous waste without a permit shall be fined not less than 100000 yuan but not more than 1 million yuan; those who fail to engage in the collection, storage, utilization and disposal of hazardous waste in accordance with the provisions of the license shall be fined not less than 50,000 yuan but not more than 500000 yuan. If a major or serious accident of environmental pollution by solid waste is caused, a fine of less than 50% of the income obtained from the unit in the previous year shall be imposed; if he commits six illegal acts, such as the unauthorized transfer of hazardous waste without approval, he shall be punished by administrative detention.
4. Whoever transfers hazardous waste through the transit of the people's Republic of China shall be ordered by the Customs to return the hazardous waste and be fined not less than 500000 yuan but not more than 5 million yuan.
What is the real impact on enterprises on the 25th day after the implementation of the new solid waste law?
According to SMM, on Sept. 3, an electric car store in the west section of Shuoxun Avenue, Qingfu Town, Yibin County, was photographed transferring hazardous waste. After receiving the report, the Gaoxian public security and environmental protection departments jointly attacked and stopped about 10 tons of hazardous waste. It is understood that since the implementation of the Law of the people's Republic of China on the Prevention and Control of Environmental pollution by solid waste (revised in 2020), the first case suspected of engaging in collection, storage, utilization and disposal of hazardous waste across provinces and without a license was detected locally. According to environmental protection professionals, under the high pressure of the relevant national and provincial departments, once the case is confirmed, the offender may face a fine of not less than 1 million yuan and not more than 5 million yuan.
According to the Suzhou Ecological and Environmental Law Enforcement Bureau, on the first day of the implementation of the new solid waste Law, Suzhou issued the city's first ticket, and an enterprise was fined 100000 yuan for setting non-standard hazardous waste warehouses.
Affected by the solid waste law, recycled lead smelting enterprises encounter problems such as the difficulty of inter-provincial transportation and the high transportation cost of using hazardous waste vehicles, the compliance supply of waste batteries is tight, and the price is easy to rise and difficult to fall. The high cost of recycled lead gives some support to the lead price.
Prospect of recycled lead industry
The year 2020 marks the end of China's 13th five-year Plan and the three-year action plan for pollution prevention and control.
For the lead industry chain, especially the recycled lead industry, in the environmental protection rectification and reform in recent years, the industrial structure continues to upgrade, and the compliance capacity expands rapidly. During this period, the first recycling standard for waste lead-acid batteries was introduced, and the extension of producer responsibility system was steadily advanced, and the revised Law of the people's Republic of China on the Prevention and Control of Environmental pollution caused by solid waste was examined and adopted at the 17th meeting of the standing Committee of the 13th National people's Congress on April 29, 2020. The new solid waste Law will come into effect on September 1, 2020.
What is the impact of the implementation of the solid waste law on the recycling channels of existing recycling enterprises? What are the opportunities and challenges for recycled lead enterprises after the implementation of the solid waste Law? What is the progress and future trend of the extension of producer responsibility for lead-acid batteries and its related policies? How to grasp the opportunities and challenges of recycled lead at the present stage?
In view of the many problems concerned by the current industry, Shanghai Nonferrous Network (SMM) will hold the 10th Summit of Renewable lead Battery Industry in 2020 in Fuyang, Anhui Province from October 15 to 16, 2020. At the meeting, there will be industry experts, corporate celebrities and senior analysts to make a comprehensive interpretation for you. In addition, in view of the recycling mode of waste lead battery, tax system, industry integration and other issues, a brainstorm is coming, opening a new chapter in the recycled lead industry!
