SMM reported on July 24 that Indonesian customs detained a shipment of alumina after detecting rare earth elements in it. The incident raised questions about whether rare earth element content affects the export eligibility of alumina under Indonesia's mineral export regulations.

The reported detention is governed by a regulatory framework that has already drawn clear purity-based lines for alumina, independent of the rules concerning rare earth products. Clarifying this distinction is crucial to understanding the unresolved issues.

Indonesian regulations do not ban all alumina exports; instead, they distinguish between prohibited and regulated alumina exports based on alumina (Al₂O₃) purity, while rare earth products are regulated separately. It is currently unclear whether the detected rare earth element content alone would cause a batch of alumina cargo that originally met specifications to become non-compliant.

Government Regulation No. 24/2026 merely provides a broader macro context for this case and does not serve as a direct basis. The document came into effect on June 1, 2026, aiming to establish a regulatory framework for the export of strategic natural resource commodities, but its initial scope of implementation only covered coal, palm oil, and ferroalloys. The framework will be directly applicable to alumina and rare earth products only after further explicit designation by the government.

Rules on How Alumina Is Categorized by Purity

The Ministry of Trade Regulation No. 23 of 2023 (whose relevant alumina schedule was amended by Ministry of Trade Regulation No. 5 of 2026 and most recently by Ministry of Trade Regulation No. 12 of 2026) incorporates compliance-grade alumina into the export control framework and requires the issuance of an export license (LS). Why Alumina Specifically

Rare earth elements may be present in bauxite raw material, but their concentration and mineralogical form vary by deposit, and it should not be assumed—absent deposit-specific evidence—that Indonesian bauxite shares the same characteristics as the ion-adsorption clay deposits of southern China. The distribution of rare earth elements during Bayer process refining depends on the mineralogy of the raw material and the specific refining process employed. Accordingly, the concentration, chemical form, and potential regulatory relevance of any rare earth elements detected in the shipment can only be assessed through laboratory test results specific to that shipment, which have not been publicly released.

It remains unclear whether the decisive factor is rare earth element concentration, detection methodology, alumina purity results, missing documentation, radiometric readings, or a combination of the above. This is precisely the clarity the market is now urgently demanding.

What This Means for Exporters

Whether this delay proves to be a one-off exception or becomes a recurring pattern will depend on whether Indonesia's Ministry of Energy and Mineral Resources (ESDM) and Ministry of Trade treat this detention as an isolated discretionary decision or as the first application of a broader standard. This uncertainty stems from the intersection of two independently developed policy tracks within Indonesia: an alumina export framework based on purity, and a strategic mineral management approach for bauxite (LTJ). The unresolved legal question exposed by this detention is whether these two policy tracks interact, such that a detected rare earth element content could override an otherwise compliant purity classification.

Exporters should not wait for customs to flag their shipments proactively. Before submitting a letter of credit application, it is a prudent precaution to review the rare earth element detection process in advance and to request written confirmation from the designated surveyor regarding testing parameters, analytical methods, acceptance criteria, and the regulatory basis. Chinese buyers of Indonesian alumina should view this matter as an ongoing development warranting sustained attention—rather than an isolated incident—at least until authorities clarify the trigger for this detention.

The core concern for the market is not simply that this shipment was tested, but that no thresholds, testing standards, or tariff exclusion provisions have yet been published to inform exporters whether—and at what levels—the rare earth element (REE) content of alumina that already meets specified purity requirements could affect its export eligibility.
SMM’s report did not identify the exporter involved, the destination, or which specific detection identified the issue with the shipment, and neither India’s Ministry of Energy and Mineral Resources (ESDM) nor its Ministry of Commerce has published any rare earth threshold standards. SMM attributed the detention of the shipment to the detection of rare earth components, however, the official legal and technical basis relied upon by the authorities has yet to be disclosed.
