Ministry of Environmental Protection: enhance the capacity of Hazardous waste Environmental Supervision, Utilization and disposal and Environmental risk Prevention

SMM: recently, in order to improve environmental quality, guard against environmental risks, maintain the safety of the ecological environment, and protect human health, the Ministry of Ecological Environment issued guidance on enhancing the environmental supervision capacity, utilization and disposal capacity and environmental risk prevention capacity of hazardous waste. The full text is as follows:

Departments (bureaus) of ecological environment of all provinces, autonomous regions and municipalities directly under the Central Government, and Ecological Environment Bureau of Xinjiang production and Construction Corps:

Hazardous waste environmental management is an important aspect of ecological civilization construction and ecological environmental protection, is an important part of the battle for pollution prevention and control, and is of great significance for improving environmental quality, preventing environmental risks, maintaining the safety of ecological environment and ensuring human health. In order to effectively enhance the ability of environmental supervision, utilization and disposal of hazardous waste and environmental risk prevention capacity (hereinafter referred to as "three capabilities"), the following suggestions are put forward.

I. General requirements

Under the guidance of Xi Jinping's thought of socialism with Chinese characteristics in the new era, deeply implement Xi Jinping's thought of ecological civilization and the spirit of the National Conference on Ecological Environmental Protection, take improving environmental quality as the core, effectively prevent environmental risks as the goal, and focus on key areas and industries on the principles of combination of dredging and blocking, first trial, step by step implementation, joint prevention and joint control, and focus on fighting a good battle for pollution prevention and control. Efforts should be made to enhance the "three capabilities" of hazardous waste and earnestly safeguard the safety of the ecological environment and the health of the people.

By the end of 2025, a hazardous waste environmental supervision system of "strict prevention at source, strict control of process and severe punishment of consequences" will be established and perfected, and the utilization and disposal capacity of hazardous waste in various provinces (autonomous regions and municipalities) will basically match the actual demand. The overall balance between the national hazardous waste utilization and disposal capacity and the actual needs, and the layout tends to be reasonable; The environmental risk prevention ability of hazardous waste has been significantly improved, and the high incidence of illegal transfer and dumping of hazardous waste has been effectively curbed. Among them, by the end of 2020, the Yangtze River Delta region (including Shanghai, Jiangsu Province, Zhejiang Province) and "waste-free cities" construction pilot cities will be the first to be realized; by the end of 2022, the Pearl River Delta, Beijing-Tianjin-Hebei and other areas of the Yangtze River Economic Belt will be implemented ahead of schedule.

II. Efforts should be made to strengthen the capacity of Environmental Supervision of Hazardous waste

(1) to improve the list of regulatory sources of hazardous waste. The eco-environmental departments at all levels shall, in combination with the second national survey of pollution sources and environmental statistics, respectively improve the list of hazardous waste production units and the list of units with hazardous waste self-utilization and disposal facilities, on this basis, combined with the list of hazardous waste business units, establish a list of key hazardous waste supervision units. Since 2020, the above list has been integrated into the unified management of the National solid waste Management Information system.

(2) to continuously promote the standardized environmental management of hazardous waste. Local eco-environmental departments at all levels should strengthen the law enforcement and inspection of hazardous waste and urge enterprises to implement the relevant legal systems and standards and regulations. All provinces (autonomous regions and municipalities) shall incorporate the standardized environmental management of hazardous waste into the index system for the performance appraisal of local environmental protection, and urge local governments to implement their regulatory responsibilities. We will promote the evaluation of the environmental credit of enterprises, bring illegal enterprises into the list of illegal and untrustworthy enterprises in the field of ecological and environmental protection, publicly expose them, and carry out joint punishment. Hazardous waste generating units and hazardous waste operating units shall be included in the scope of compulsory liability insurance for environmental pollution in accordance with the law.

(3) to strengthen the environmental supervision of the whole process of hazardous waste. Local eco-environmental departments at all levels shall strictly examine and approve hazardous waste operation licenses and shall not devolve the examination and approval authority without authorization in violation of state laws and regulations; an effective linkage mechanism shall be established between the examination and approval of hazardous waste operation licenses and the examination and approval of environmental impact assessment documents. For new projects, the guidelines for Environmental impact Assessment of Hazardous waste and Technical guidelines for Hazardous waste disposal projects should be strictly implemented. Increase the proportion of technical check and spot check of environmental impact assessment documents for construction projects in key hazardous waste industries, and if the types, quantities and utilization and disposal methods of hazardous wastes put into operation for a long time are seriously inconsistent with the original environmental impact assessment documents, it shall be rectified and reformed as soon as possible in accordance with the requirements of existing laws, regulations and guidelines on hazardous waste; if an illegal act is constituted, a strict punishment shall be imposed in accordance with the law. In combination with the implementation of the sewage discharge permit system for fixed pollution sources, solid waste will be included in the sewage discharge permit management in accordance with the law. The daily environmental supervision of hazardous waste will be brought into the content of "double random and one public" of ecological environment law enforcement. We will optimize the examination and approval procedures for the interprovincial transfer of hazardous waste, clarify the time limit for examination and approval, and run electronic bills to facilitate the cross-regional transfer and utilization of hazardous waste.

(4) strengthening the building of regulatory institutions and the contingent of qualified personnel. We will strengthen training in the environmental management of hazardous waste throughout the country, encourage hazardous waste production units and hazardous waste business units that rely on better conditions to build hazardous waste training and practice bases, and strengthen technical training and exchanges for personnel of ecological environmental protection inspectors, environmental impact assessment, sewage discharge permits, environmental law enforcement and solid waste management institutions. We will strengthen the building of professional institutions and talent teams for hazardous waste, set up a team of experts on hazardous waste environmental management, and strengthen the technical support for key and difficult issues.

(5) to enhance the ability and level of information supervision. We will carry out online registration and management plans for hazardous waste production units, fully operate the electronic joint list for hazardous waste transfer, and realize a "network" for the information management of hazardous waste across the country by the end of 2019. All localities should ensure the operation and maintenance personnel and funds of the solid waste management information system, and ensure the operation of the network and the security of network information. Through the information system to disclose hazardous waste-related information in accordance with the law, and build an information exchange platform. Areas with conditions are encouraged to implement integrated intelligent monitoring means such as video surveillance and electronic tags in key links and key nodes of key units to realize the tracking and management of the whole process of hazardous waste. All localities should make full use of the "Internet + supervision" system, strengthen environmental supervision after the incident, collect and share all kinds of relevant data, and timely discover and prevent emerging risks.

III. Efforts should be made to strengthen the capacity for the utilization and disposal of hazardous waste

(6) to co-ordinate the building of hazardous waste disposal capacity. We will promote the establishment of a hazardous waste disposal system with "overall capacity matching within provinces, coordination and cooperation among provinces and regions, and national coordination for special categories".

The provincial eco-environmental departments should complete the assessment of hazardous waste generation, utilization and disposal capacity and facility operation by the end of 2020, scientifically formulate and implement plans for the construction of hazardous waste centralized disposal facilities, and promote local governments to incorporate hazardous waste centralized disposal facilities into the overall construction of local public infrastructure. It also gives policy guarantee in terms of tax revenue, capital investment and construction land for centralized incineration and landfill disposal of hazardous waste.

The Yangtze River Delta, the Pearl River Delta, Beijing-Tianjin-Hebei and other areas of the Yangtze River Economic Belt should carry out regional cooperation in the centralized disposal of hazardous waste and coordinate the planning and sharing of the centralized disposal capacity of hazardous waste across provinces and regions. Encourage the provinces that carry out regional cooperation to explore the use of a "whitelist" for the examination and approval of the interprovincial transfer of hazardous waste. To explore the establishment of eco-environmental protection compensation mechanism for transregional transfer and disposal of hazardous waste.

For the hazardous waste with regional distribution characteristics, such as polychlorinated PhH waste and Hg waste, which need to be disposed of specially, the whole country should be co-ordinated and relatively concentrated, so as to create a specialized utilization and disposal base. We will strengthen the capacity building for the utilization and disposal of hazardous wastes such as waste acid, waste salt and municipal solid waste incineration fly ash.

We will encourage oil exploitation, petrochemical, chemical, non-ferrous and other industrial bases and large enterprise groups to build high-standard hazardous waste utilization and disposal facilities according to their own needs. We will encourage the construction of facilities for centralized storage, pretreatment and disposal of hazardous waste in chemical and other industrial parks.

(7) to promote the reduction and resource utilization of hazardous waste at source. Enterprises should take measures such as cleaner production to reduce the production and harmfulness of hazardous waste from the source, and give priority to the internal resource utilization of hazardous waste. Regions with conditions are encouraged to formulate pollution control standards or technical specifications for the resource utilization of hazardous waste in the light of the local actual situation. Provincial eco-environmental departments are encouraged to explore pilot projects for the exemption and management of hazardous waste operating permits for "point-to-point" targeted utilization of hazardous waste on the premise that environmental risks can be controlled.

(8) to promote the optimization of the capacity structure for the utilization and disposal of hazardous waste. Encourage leading enterprises of hazardous waste to become bigger and stronger by means of merger and reorganization, promote specialization and large-scale utilization of hazardous waste, build large-scale hazardous waste incineration and disposal facilities with advanced technology, and control direct landfill of hazardous waste that can be incinerated and reduced. Develop guidelines for the review of hazardous waste business licenses for key categories and carry out performance evaluation of hazardous waste utilization and disposal facilities. To support the cross-regional overall layout of large enterprise groups and the sharing of hazardous waste utilization and disposal facilities within the group.

(9) to improve the hazardous waste collection system. Provincial eco-environmental departments are encouraged to select typical regions, typical enterprises and typical types of hazardous waste, and organize pilot work for centralized collection and storage of hazardous waste. We will implement the extended producer responsibility system, promote qualified production enterprises to rely on sales outlets to recover hazardous waste from the use of their products, carry out pilot work on centralized collection and cross-regional transfer system for lead battery production enterprises, and rely on mineral oil production enterprises to carry out pilot construction of waste mineral oil collection networks.

(10) to promote the construction of medical waste disposal facilities. Strengthen cooperation with health departments, formulate a plan for the construction of centralized medical waste disposal facilities, and set up districts and cities by the end of 2020 to meet the actual needs of the region; by the end of June 2022, counties (cities) have a relatively perfect medical waste collection, transportation and disposal system. Medical and health institutions that do not have the conditions for centralized disposal shall build their own medical waste disposal facilities that meet the requirements. Encourage the development of mobile clinical waste disposal facilities to provide on-site disposal services for remote grassroots units. Provinces (autonomous regions and municipalities) should establish a coordinated emergency disposal mechanism for medical waste to ensure the emergency disposal capacity of medical waste during the period of sudden epidemic situation and maintenance of disposal facilities.

(11) standardize the coordinated disposal of cement kilns and industrial furnaces. Appropriate development of cement kiln cooperative disposal of hazardous waste project, as a useful supplement to the utilization and disposal capacity of hazardous waste. The cement kiln which can effectively give full play to the function of cooperative disposal of hazardous waste can reduce and reduce the corresponding emission reduction measures according to the actual disposal capacity during the period of heavy pollution weather early warning. Support industrial furnace and kiln cooperative disposal of hazardous waste technology research and development, relying on qualified enterprises to carry out iron and steel smelting and other industrial furnace and kiln cooperative disposal of hazardous waste pilot.

IV. Efforts should be made to strengthen the ability of environmental risk prevention of hazardous waste

(12) improve the system of policies, regulations and standards. We will implement the Law of the people's Republic of China on the Prevention and Control of Environmental pollution by solid waste, study and revise the measures for the Administration of Hazardous waste Operation licenses, the measures for the Administration of Hazardous waste transfer, and other laws and regulations. Revise pollution control standards for hazardous waste storage, incineration and collaborative disposal of cement kilns. We will cooperate with relevant departments to improve the preferential catalogue of value-added tax on the Comprehensive Utilization of Resources and Labor Services, and promote the improvement of preferential tax policies for the utilization of hazardous waste and the charging system for disposal.

(13) efforts should be made to solve the problem of difficult identification of hazardous wastes. To promote the classified management of hazardous waste, to dynamically revise the National Hazardous waste list and the exemption management list, and to study the establishment of a hazardous waste removal list. Revise the "Hazardous waste Identification Standard", "Hazardous waste Identification Technical Specification" and other standard specifications. To study and formulate measures for the management of hazardous waste identification units, strengthen the responsibility of enterprises for hazardous waste identification, and encourage scientific research institutes and standardized testing institutions to carry out hazardous waste identification.

(14) to establish regional and departmental mechanisms for joint prevention, joint control and joint governance. We will promote the formulation of joint hazardous waste prevention and control plans in the Yangtze River Delta and other regions. Local eco-environmental departments at all levels shall strengthen the environmental supervision and management of hazardous waste in accordance with relevant laws and regulations on environmental protection, and shall establish cooperation mechanisms with relevant administrative departments such as development and reform, hygiene and health, transportation, public security and emergency response, strengthen information sharing and cooperation, and promptly hand over to the public security organs the problems of suspected hazardous waste and environmental crimes found in the inspection of ecological environment law enforcement. If problems involving safety and fire control are found, the clues shall be handed over to the relevant administrative departments in a timely manner.

(15) strengthening the prevention and control of environmental risks in chemical parks. In-depth investigation of the hidden dangers of environmental risks in chemical parks, and urge the implementation of the main responsibility of environmental protection in chemical parks and the requirements for the utilization and disposal of hazardous waste "one garden, one policy". The new park should scientifically evaluate the type and quantity of hazardous waste produced by enterprises in the park, and ensure the utilization and disposal capacity of hazardous waste. Conditional chemical parks are encouraged to establish an intelligent traceability control platform for hazardous waste to realize the whole process of hazardous waste management and control in the park.

(16) to enhance the environmental emergency response capacity of hazardous waste. We will further promote cross-regional and cross-departmental emergency disposal of environmental emergencies and hazardous waste generated in the process of handling them, and improve the on-site command and coordination system, as well as information reporting and disclosure mechanisms. We will strengthen the construction of management and expert teams for the emergency disposal of hazardous waste generated in the course of environmental emergencies and their treatment, and incorporate the leading enterprises in the utilization and disposal of hazardous waste into the emergency disposal system for environmental emergencies.

(17) severely crack down on environmental violations of solid waste. By the end of October 2020, focus on the Yangtze River Economic Belt, in-depth "waste action"; in conjunction with relevant departments, focusing on hazardous wastes such as medical waste, waste acid, waste lead storage batteries, waste mineral oil, and so on, we will continue to crack down on illegal and criminal activities against the environment of solid waste. In combination with the overall planning of eco-environmental protection, we will strengthen supervision and carry out special inspections of hazardous waste management units in stages and in batches.

(18) strengthening scientific and technological support for the prevention and control of hazardous waste pollution. We will build regional laboratories for testing and analysis of hazardous waste and chemicals, environmental risk assessment and pollution control, give full play to the role of the National Engineering and Technology Center for Hazardous waste disposal, and strengthen basic research on hazardous waste environmental risk assessment and pollution control technology. We will encourage the research, application, demonstration and popularization of pollution prevention, utilization and disposal technologies for hazardous waste such as waste acid, waste salt and municipal solid waste incineration fly ash. To carry out hazardous waste surveys in key industries, and formulate supporting policies, standards and norms for the prevention and control of hazardous waste pollution in key industries and key categories in stages.

V. safeguard measures

(19) strengthen organization and implementation. Eco-environmental departments at all levels should fully understand the importance of enhancing the "three capacities" of hazardous waste, refine working measures, and clarify the division of tasks, timetable, road map, and responsible persons, so as to ensure that all tasks are implemented in place.

(20) compacting local responsibility. We will establish and improve a long-term accountability mechanism for environmental inspectors of hazardous waste pollution, and carry out special inspections where cases of environmental violations of hazardous waste occur frequently, where the disposal capacity is seriously insufficient, and cause serious environmental pollution or adverse social impact. And carry out inspection and accountability in accordance with discipline and in accordance with the law.

(21) increase investment. We will strengthen the financial support for the construction of the "three capacities" of hazardous waste. All localities should, in the light of reality, establish funding channels for the construction of the "three capacities" of hazardous waste in various forms, such as coordinating all kinds of special funds and guiding the participation of social funds.

(22) strengthening public participation. We will encourage the reporting of illegal transfer, dumping and disposal of hazardous wastes to be included in the scope of key incentives, so as to enhance the enthusiasm of the public and social organizations to participate. Promote the opening of hazardous waste utilization and disposal facilities to the public. We will strengthen publicity on the investigation and handling of major environmental cases involving hazardous waste, form a strong deterrent, and create a good social atmosphere.
