[US Trade Court Rules Trump’s Global Tariffs Illegal]
A U.S. Court of International Trade panel has struck down most of President Donald Trump’s global tariffs, ruling they were unlawfully enacted under emergency powers. The decision halts key components of Trump’s trade agenda, including blanket tariffs and specific levies targeting China, Canada, and Mexico tied to fentanyl concerns. However, tariffs imposed under separate authorities, such as Section 232 (steel and aluminum) and Section 301 (retaliation against unfair trade practices), remain intact.
The court found that Trump exceeded his authority under the International Emergency Economic Powers Act (IEEPA), concluding that trade deficits and drug trafficking concerns cited as national emergencies were not valid justifications for sweeping tariff actions. The ruling came in response to lawsuits from Democrat-led states and small business groups who argued the measures unlawfully bypassed Congressional authority and functioned as consumer taxes. Trump may appeal the decision, which could ultimately reach the U.S. Supreme Court.
