






SMM: on October 10th, in order to strengthen the management of echelon utilization of batteries of new energy vehicles, improve the level of comprehensive utilization of resources, and ensure the quality of products of echelon utilization of batteries, the Department of Energy Saving and Comprehensive Utilization of the Ministry of Industry and Information Technology organized and compiled the measures for the Management of echelon Utilization of batteries of New Energy vehicles and openly solicited opinions.

I. General principles
Article 1 in order to strengthen the management of echelon utilization of power batteries of new energy vehicles, improve the level of comprehensive utilization of resources, ensure the quality of echelon utilization battery products (hereinafter referred to as echelon products), and protect the ecological environment, These measures are formulated in accordance with the Law of the people's Republic of China on the Prevention and Control of Environmental pollution by solid waste, the Law of the people's Republic of China on the Promotion of Circular economy and the interim measures for the Administration of Recycling and Utilization of batteries for New Energy vehicles (hereinafter referred to as the "Administrative measures").
Article 2 the term "echelon utilization" as mentioned in these measures refers to the process of necessary inspection, classification, separation, battery repair or reorganization into echelon products, so that they can be applied to other fields.
The term "echelon utilization enterprises" as mentioned in these measures refers to enterprises engaged in the production of echelon products. The definitions of recycling enterprises and waste power batteries in the Management measures apply to these measures.
Article 3 these measures shall apply to the management of echelon utilization-related behaviors of enterprises and other relevant market entities within the territory of the people's Republic of China (except Taiwan, Hong Kong and Macao).
Article 4 the echelon utilization enterprise shall perform its principal responsibility, follow the concept of the whole life cycle, implement the extension system of producer responsibility, ensure the quality of echelon products produced by the enterprise, as well as standardized recovery and environmental protection disposal after scrapping; power battery production enterprises should adopt product structure design that is easy to be used by echelons, which is conducive to their efficient echelon utilization.
Article 5 the Ministry of Industry and Information Technology shall be responsible for the guidance and coordination of the management of echelon utilization of power batteries throughout the country. The Ministry of Ecology and Environment, the Ministry of Commerce and the General Administration of Market Supervision shall supervise and manage the echelon utilization of power batteries within their respective responsibilities and strengthen information sharing.
The competent departments of industry and informatization of all provinces, autonomous regions, municipalities directly under the Central Government and the Xinjiang production and Construction Corps, together with the competent departments of ecological environment, commerce and market supervision at the same level, coordinate and do a good job in the guidance, supervision and management of echelon utilization in their respective regions.
Article 6 the Ministry of Science and Technology shall support the research, development, popularization and application of key common technologies and equipment, guide industry-university-research-application cooperation, and encourage the innovation of new business models and the construction of demonstration projects.
Second, the requirements of echelon utilization enterprises
Article 7 echelon utilization enterprises shall meet the relevant requirements of the Industry Standard conditions for Comprehensive Utilization of waste Power Storage batteries of New Energy vehicles (announcement No. 59 of the Ministry of Industry and Information Technology of 2019). Encourage the use of advanced and applicable technology and equipment for the echelon utilization of waste power batteries at the package (group) and module level.
Article 8 echelon products are encouraged to make use of enterprises to develop and produce echelon products suitable for base station power preparation, energy storage, recharging and other fields, and echelon products such as portable battery and handheld lighting equipment that are not easy to be recycled shall not be developed. Encourage the use of leasing, large-scale utilization and other business models that facilitate echelon product recycling.
Article 9 encourage echelon utilization enterprises to cooperate with enterprises such as the production of new energy vehicles, the production of power batteries and the recovery and disassembly of scrapped motor vehicles, strengthen information sharing and make use of existing recycling channels, efficient recycling of waste power batteries for echelon utilization.
Article 10 when an echelon utilization enterprise engages in the echelon utilization of waste power storage battery, it shall, in accordance with the requirements of relevant state laws and regulations, coordinate with new energy vehicles and power battery production enterprises to solve problems related to intellectual property rights.
Article 11 Echelon enterprises are encouraged to make use of the ex-factory technical specification information and charging rate information of power batteries, as well as the monitoring data information (voltage, temperature, SOC, etc.) stipulated in relevant national standards, and combined with the actual test data, evaluate the residual value of waste power batteries, improve the efficiency of echelon utilization, and improve the performance, reliability and economy of echelon products.
Article 12 the echelon utilization enterprise shall standardize the echelon utilization, have the echelon product quality management system and the necessary inspection equipment and facilities, and pass the certification of the quality management system, the inspection rules and methods of echelon products adopted meet the requirements of relevant standards, and shall be responsible for warranty and after-sales service for the echelon products produced and sold by the enterprise.
Article 13 the echelon utilization enterprise shall establish a traceability management system, file the manufacturer's code application and coding rules in accordance with the relevant state regulations on traceability management, and upload relevant traceability information such as echelon products, waste power batteries and other relevant traceability information to the National Monitoring and Power Battery recovery and Utilization Integrated Management platform (www.evmam-tbrat.com) of new energy vehicles, so as to ensure that the traceability information is uploaded timely, truthfully and accurately.
Third, echelon product requirements
Article 14 the design of echelon products shall comprehensively consider such factors as electrical insulation, flame retardant, thermal management and battery management, ensure the reliability of echelon products, and adopt structures and connection modes that are easy to maintain, disassemble and disassemble, so as to facilitate disassembly, disassembly and recycling after scrapping.
Article 15 performance tests shall be carried out to verify the performance of echelon products, and their electrical performance, safety and reliability shall meet the requirements of nominal capacity, nominal voltage and relevant national standards in the field of application.
Article 16 echelon products shall be marked by commodity bar code, and shall be uniformly coded in accordance with the Automobile Power Battery coding rules (GB/T34014), indicating (but not limited to) nominal capacity, nominal voltage, echelon use of enterprise name, address, product origin, product implementation standard, traceability code and other information, and retain the original power battery code.
Article 17 the instructions for the use of echelon products or other accompanying documents shall remind the relevant matters and requirements that should be paid attention to in the process of use protection, operation monitoring, inspection and maintenance, scrapping and recycling of echelon products.
Article 18 the echelon products shall adopt appropriate packaging protection methods according to the characteristics of the products, and the packaging and transportation shall meet the requirements of the relevant standards such as "vehicle Power Battery Recycling Management Code, part 1 Packaging and Transportation Standard" (GB/T38698.1).
Article 19 the General Administration of Market Supervision shall, in conjunction with the Ministry of Industry and Information Technology, establish a voluntary certification system for echelon products. The echelon products that have obtained the certification may use the battery product logo on the products and packaging (see attachment).
IV. Requirements for recycling
Article 20 echelon utilization enterprises shall, in accordance with the relevant requirements of the guidelines for the Construction and Operation of New Energy vehicle Power Storage Battery Recycling Service Network (announcement No. 46 of the Ministry of Industry and Information Technology of the people's Republic of China), establish scrapped echelon product recovery service outlets matched with product sales, submit recycling service network information and publish it to the public on the enterprise website. Encourage echelon utilization enterprises to cooperate with new energy vehicle production enterprises to build and share recycling systems, so as to improve recovery efficiency.
Article 21 echelon utilization enterprises shall standardize the recovery of scrapped power batteries and scrapped echelon products produced in the process of production and testing of their echelon products, and shall, in accordance with the requirements of the Management measures, be centrally stored and handed over to recycled enterprises for disposal, shall not be discarded or disposed of at will, and shall carry out the work of information disclosure in accordance with the relevant requirements of the State.
Article 22 the owner of the echelon product shall hand over the scrapped echelon product to the recycling service network established by the echelon enterprise or the recycling enterprise for standardized treatment, and shall not discard or dispose of it at will.
Article 23 if the echelon makes use of the enterprise or the owner of the echelon product to disassemble or disassemble the scrapped echelon product without authorization, or hand it over to another third party, resulting in an accident, it shall bear the corresponding responsibility.
V. Supervision and management
Article 24 the local departments in charge of industry and information technology at or above the county level, together with the relevant competent departments at the same level, shall supervise and inspect the production and traceability of the echelon products of enterprises, so as to ensure the standardized and efficient development of echelon utilization.
Article 25 the competent departments of local market supervision at or above the county level shall supervise the quality of echelon products in accordance with the requirements of the Product quality Law and compulsory standards of the state, and the relevant enterprise-related information such as administrative penalties and random inspection results shall be published through the national enterprise credit information publicity system in accordance with the law.
Article 26 Local departments in charge of ecological environment at or above the county level shall, in accordance with their duties, supervise the prevention and control of environmental pollution in activities such as the production of echelon utilization enterprises and the utilization and disposal of scrapped echelon products recycling enterprises. those who violate the relevant requirements of environmental protection shall be dealt with in accordance with the relevant laws and regulations of environmental protection.
Article 27 the local departments in charge of commerce at or above the county level shall, in conjunction with the relevant competent departments at the same level, supervise and administer the dismantling and disassembly of scrapped motor vehicle recovery and disassembly enterprises, the sale of power batteries and the input of power battery information in accordance with the relevant provisions of the State.
Article 28 the Ministry of Industry and Information Technology, together with relevant departments, shall organize and establish a technical committee for the management of echelon utilization of power batteries of new energy vehicles, which shall be responsible for coordinating the major technical issues in the management of echelon utilization of power batteries of new energy vehicles, support the formulation of relevant policies, industry information analysis and other work.
Article 29 any organization or individual shall have the right to complain and report to the relevant departments about violations of the provisions of these measures.
VI. Supplementary provisions
Article 30 the Ministry of Industry and Information Technology, the Ministry of Ecology and Environment, the Ministry of Commerce and the General Administration of Market Supervision shall be responsible for the interpretation of these measures.
Article 31 these measures shall enter into force 30 days after the date of issuance.
