Celgard, a US company, sued Xingyuan American Research Institute for unfair competition and other acts.

On May 26th, Xingyuan announced that the company received Celgard's lawsuit against Xingyuan and Xingyuan USA Research Institute for allegedly infringing its trade secrets and unfair competition.

SMM5 March 28: on May 26th, Xingyuan material announced that the company received Celgard's lawsuit against Xingyuan material and Xingyuan American Research Institute for allegedly infringing its trade secrets and unfair competition on May 22nd.

According to the announcement, on May 22, 2020, Celgard,LLC (hereinafter referred to as "Celgard") transmitted a number of litigation materials to the American lawyers of Shenzhen Xingyuan material Technology Co., Ltd. (hereinafter referred to as "the Company" or "Xingyuan material"). Based on the above materials, Celgard sued Xingyuan material and the Company's wholly-owned subsidiary ShenzhenSeniorTechnologyMaterialCo.Ltd. (US) ResearchInstitute (in the Federal District Court for the Western District of North Carolina (hereinafter referred to as "Xingyuan American Research Institute"). In the indictment, Celgard claimed that the company and Xingyuan American Research Institute were suspected of infringing its trade secrets and unfair competition.

Xingyuan material said that since its establishment, the company has always focused on the research and development and manufacture of lithium-ion battery separators, with independent research and development capabilities of dry, wet and coating diaphragms, as well as strong diaphragm technology reserves. For a long time, the company has attached great importance to intellectual property protection, all the diaphragm products produced by the company have fully independent intellectual property rights or have obtained the relevant intellectual property rights license.

It is reported that Polypore International, LP, the parent company of Celgard, recently submitted an application for an emergency injunction against Xingyuan material to the British High Court. On May 7, the court issued a unilateral temporary injunction prohibiting Xingyuan material from importing some battery diaphragm products into the UK. Celgard will impose an injunction on Xingyuan material through a trial and ask the latter to pay compensation for the misuse of its trade secrets.
