Circular on continuously strengthening the order and rectification of the rare Earth Industry issued by the Twelve departments

On January 4, the website of the Ministry of Industry and Information Technology issued a notice of 12 departments, including the Ministry of Industry and Information Technology, on continuously strengthening the order rectification of the rare earth industry (hereinafter referred to as the "notice"). The circular makes it clear that focusing on outstanding problems that disturb the order of the industry, such as illegal digging, stealing, mining, and processing illegal rare earth mineral products, strengthening investigation and punishment, focusing on the establishment of a regular working mechanism, supervision and inspection will run through the whole process of rectification in accordance with the law, earnestly implement the responsibility of group control and local supervision, and realize the order and order of rare earth mining, production, circulation, import and export, and stable and reasonable product prices. The utilization of resources is green and environmental protection, the quality of development is constantly improving, and the strategic supporting role of rare earth resources has been brought into full play. The circular requires that the management of key links be strengthened. The first is to ensure the orderly exploitation of rare earth resources; the second is to strictly implement the plan for the separation of mining and smelting; the third is to standardize the comprehensive utilization of resources; and the fourth is to strengthen the supervision of product circulation. In addition, the notice also calls for continuous strengthening of industry self-discipline and improve the quality of industry development.

Announcement on issues related to the issuance of VAT invoices by rare Earth Enterprises and other Chinese character Anti-counterfeiting Project Enterprises issued by the State Administration of Taxation

In March 2019, the announcement of the State Administration of Taxation on issues related to the issuance of VAT invoices by rare earth enterprises and other Chinese character anti-counterfeiting project management enterprises. In order to meet the needs of the development of rare earth industry and tax information construction, the Chinese character anti-counterfeiting project of VAT anti-counterfeiting tax control system has been suspended since June 1, 2019. In order to clarify the matters related to the issuance of VAT invoices by rare earth enterprises and other Chinese character anti-counterfeiting project management enterprises. If a rare earth enterprise sells rare earth products or provides rare earth taxable services or services, it shall issue special invoices for rare earths through the upgraded VAT invoice management system; if it sells non-rare earth products or provides non-rare earth taxable services or services, it shall not issue special invoices for rare earths; other enterprises included in the management of VAT Chinese character anti-counterfeiting projects shall issue VAT invoices using the upgraded VAT invoice management system. The invoice password area issued by these two types of enterprises will be changed from QR code ciphertext to character ciphertext.

The total amount of the first rare earth indicators announced in 2019 decreased by 18% compared with the same period last year.

On March 15, the website of the Ministry of Industry and Information Technology announced the notice of the first batch of rare earth mining and smelting separation total control plans issued by the Ministry of Industry and Information Technology and the Ministry of Natural Resources in 2019. The first batch of targets for 2019, set at 50 per cent of the total target for 2018, were 60000 tons and 57500 tons, respectively, a decrease of 18 per cent compared with the same period in 2018 (a total of 60000 tons of mineral products, a decrease of 13500 tons; 57500 tons of smelting separation products, a decrease of 12500 tons). However, depending on the demand and the use of the targets, the second batch will be issued by the end of June 2019, taking into account market demand and the implementation of the groups.

At the same time, rare earth smelting and separation enterprises are required to use backward production processes and smelting separation capacity that have been listed in the prohibited or eliminated catalogue and whose smelting separation capacity is less than 2000 tons of (REO) / year, or have been explicitly requested by the relevant departments to stop production and rectification, organize production according to the plan, strictly abide by relevant laws and regulations such as environmental protection and resource development, and strictly prohibit unlicensed and cross-border mining of rare earth resources. Comprehensive utilization enterprises shall not process rare earth mineral products (including imported minerals); complete import formalities shall be provided for the utilization of overseas rare earth resources, and the purchase and usage shall be truthfully reported in the rare earth product traceability system.

In April 2019, the Guide Catalog for Industrial structure Adjustment (2019, draft for soliciting opinions) released a number of rare earth products. On April 8, the National Development and Reform Commission issued a public announcement on the guidance Catalog for Industrial structure Adjustment (2019, draft for soliciting opinions). It is reported that the "Industrial structure Adjustment Guide Catalog (2019, draft for soliciting opinions)" is composed of three categories: encouragement, restriction and elimination.

Ministry of Industry and Information Technology carries out Special Energy Saving Supervision around key work in 2019

April 2019 Ministry of Industry and Information Technology: special energy conservation supervision (including magnetic material enterprises) will be carried out around key work in 2019. The work plan points out that special energy conservation supervision should be carried out in depth around key work. Including: special supervision of energy consumption in key energy-consuming industries, special supervision on the implementation of ladder electricity price policy, special supervision on energy efficiency improvement of key energy products and equipment, special supervision on energy efficiency in data centers, and special supervision on the rectification and implementation of illegal enterprises in 2018.

11 rare Earth Industry Standards submitted for approval by the Ministry of Industry and Information Technology

In April 2019, 11 rare earth industry standards were submitted for approval. Ministry of Industry and Information Technology: 198 chemical, petrochemical, metallurgical and other industry standards submitted for approval. According to the industry standard system, Relevant standardization technical organizations and other units have completed 24 chemical industry standards, such as "monoammonium Phosphate containing Humic Acid, diammonium Phosphate", 6 petrochemical industry standards, such as "Design Code for Petrochemical Center Laboratory", 40 metallurgical industry standards, such as "functional refractory products for continuous casting", 110 nonferrous industry standards such as "copper tellurium alloy rods", 7 building materials industry standards, such as "artificial quartzite and gangstone flooring for construction". The preparation and revision of 11 rare earth industry standards, such as "lanthanum cerium sulfide".

25% tariff on rare earth metal mines in Sino-US trade dispute

On May 9, 2019, the United States Government announced that with effect from May 10, 2019, the tariff rate on $200 billion of listed goods imported from China would be increased from 10 per cent to 25 per cent. The above measures by the United States have led to the escalation of Sino-US economic and trade frictions, violated the consensus of China and the United States on resolving trade differences through consultations, harmed the interests of both sides, and did not meet the general expectations of the international community. However, rare earth-related products are not included in the list of goods levied by the United States. Affected by the tariff imposed by the United States, the tariff Commission of the State Council announced that the tariff rate would be increased on some US imports from June 1. Rare earth products are also among them, with a 25% tariff on rare earth metal mines, some of which range from 5% to 25%.

Ministry of Industry and Information Technology issues Packaging, marking, Transportation and Storage of rare Earth products

In June 2019, the Ministry of Industry and Information Technology also issued a compulsory national standard entitled "Packaging, marking, Transportation and Storage of rare Earth products" to publicize it and listen to the opinions of all sectors of the community. The standard points out that it is required to increase the traceability of raw materials in the packaging, labeling, transportation and storage standards of rare earth products. At a news conference on June 17, the NDRC once again stated that it would strengthen the rectification and regulation of the rare earth industry and build a long-term regulatory mechanism in view of the problem of illegal production in the rare earth industry.

In the "anti-triad" operation, the "regular army" six rare earth groups (Chinalco, northern rare earths, Xiamen tungsten industry, China Minmetals, Guangdong rare earths, southern rare earths) are also included in the scope of rectification.

The National people's Congress adopted the Resource tax Law of the people's Republic of China

In August 2019, the Resource tax Law of the people's Republic of China was adopted at the 12th meeting of the standing Committee of the Thirteenth National people's Congress on August 26, 2019. This Law shall enter into force on September 1, 2020. The interim regulations of the people's Republic of China on Resource tax promulgated by the State Council on December 25, 1993 shall be annulled at the same time. Among them, the newly announced tax on light rare earth resources is 7%-12%, and that on medium and heavy rare earths is 20%. The original resource tax is 27% for medium and heavy rare earth ore, 11.5% for Baotou mine, 9.5% for Sichuan mine and 7.5% for Shandong mine. The resource tax will promote fair competition in the rare earth industry.

Ministry of Industry and Information Technology releases heavy rare Earth Index and Light rare Earth Index increase in six groups of rare Earth Mining and smelting Indexes in 2019

On November 8, the website of the Ministry of Industry and Information Technology issued a circular from the Ministry of Industry and Information Technology of the Ministry of Natural Resources on issuing the total control index of rare earth mining and smelting separation and the total control index of tungsten mining in 2019. On the whole, the mining index increased by 12000 tons, and the smelting separation index increased by 12001 tons, in line with the calls of some people in the industry to increase the supply of resources. On the subdivided ore, the increased mining indexes are rock and mineral type rare earth (light). As the dominant resources in China, the ionic rare earth (mainly medium weight) index is flat, which reflects the thinking of the competent department on the differential management of resources.
