Insurance firm files lawsuit against Texas metal recycler

AUSTIN (Scrap Monster): An insurance company has filed a lawsuit seeking a verdict to exempt them from paying a claim. The lawsuit was filed by Canopius US Insurance in the Houston Division of the Southern District of Texas against Texas Metal Scrap Recyclers LLC of Houston.

According to the complaint, Canopius claims that it no obligation to pay personal injury claim, attorney fees and court costs as personal injury caused by use of automobiles are not covered under the policy. The claim was raised following an incident that took place in February on the property of Technip USA Inc in Sulphur, La, operated by Texas Metal Scrap Recyclers LLC.

The insurance firm claims that Technip USA Inc in Sulphur, La and other facilities operated by Texas Metal Scrap Recyclers LLC are not listed in the policy declarations. Hence, the businesses conducted at those facilities do not fall under the scope of the policy. Moreover, the policy does not provide insurance coverage for injuries caused by use of automobiles such as pick-up truck. Also, coverage will not be available if the injury is excluded under another coverage clause.
