In order to protect resources and environment and strengthen the administration of the export of rare metals, in accordance with the relevant provisions of the Foreign Trade Law of the people's Republic of China and the regulations of the people's Republic of China on the Administration of Import and Export of goods, our Ministry has formulated the declaration conditions and procedures for the export of state-owned trading enterprises of tungsten, antimony and silver in 2022-2023, which is hereby announced.
I. declaration conditions of state-owned trading enterprises for the export of tungsten
(1) production enterprises.
1. With independent legal person and import and export business qualifications, the bank credit line is not less than 200 million yuan.
two。 Through the ISO9000 series quality system certification.
3. Abide by the national laws and regulations on production safety, participate in pension, unemployment, medical treatment, industrial injury, childbirth and other social insurance in accordance with the law, and pay the social insurance premium on time and in full, and pass the OHSAS18000/ISO45001 occupational health and safety system certification.
4. Enterprises that have obtained export qualifications will have tungsten export performance every year from 2018 to 2020 (enterprises qualified for export state trade after 2016 will have tungsten export performance every year from 2016 to 2020); the average annual export supply of newly declared enterprises in the past three years is not less than 2000 tons (equivalent to ammonium paratungstate APT). The export performance shall be subject to customs statistics, and the export supply performance shall be subject to the data reviewed by the industry organization.
Where the products produced by enterprises are listed in the Export Catalog of China's High-tech products issued by the Ministry of Science and Technology, the Ministry of Commerce, the Ministry of Finance, the State Administration of Taxation and the General Administration of Customs, or the catalogue of China's High-tech products issued by the Ministry of Science and Technology, or the high-tech products approved by the Ministry of Science and Technology, the standards may be appropriately lowered according to the specific conditions
5. It has obtained the certification of ISO14000 series environmental management system.
6. The enterprise operates legally in accordance with the rules and regulations, complies with the laws and regulations of production safety, environmental protection, taxation, customs and foreign exchange management, and there are no uncorrected violations of laws and regulations.
(2) Circulation enterprises.
1. With independent legal person and import and export business qualifications, the bank credit line is not less than 200 million yuan.
There are annual tungsten export achievements from 2.2018 to 2020 (subject to customs statistics).
3. Participate in pension, unemployment, medical treatment, industrial injury, childbirth and other social insurance in accordance with the law and pay social insurance premiums in full on schedule.

II. Declaration conditions of antimony export state-owned trading enterprises
(1) production enterprises.

3. Abide by the relevant national laws and regulations on production safety, participate in social insurance such as old-age pension, unemployment, medical treatment, industrial injury and childbirth, and pay social insurance premiums in full on time.
4. Enterprises that have obtained export qualifications will have antimony export performance every year from 2018 to 2020 (enterprises qualified for export state trade after 2018 will have antimony export performance every year from 2018 to 2020). The average annual export supply of newly declared enterprises in the past three years is not less than 7000 tons (refined antimony) or 5000 tons (antimony oxide). The export performance shall be subject to customs statistics, and the export supply performance shall be subject to the data reviewed by the industry organization. Where the products produced by enterprises are listed in the Export Catalog of China's High-tech products issued by the Ministry of Science and Technology, the Ministry of Commerce, the Ministry of Finance, the State Administration of Taxation and the General Administration of Customs, or the catalogue of China's High-tech products issued by the Ministry of Science and Technology, or the high-tech products approved by the Ministry of Science and Technology, the standards may be appropriately lowered according to the specific conditions

III. Declaration conditions of Silver Export State-owned Trading Enterprises
(1) production enterprises.
1. With independent legal person and import and export business qualifications.
two。 Enterprises that have obtained export qualifications will have silver export performance from 2018 to 2020 (enterprises qualified for export state trade after 2018 will have silver export performance every year from the year of qualification to 2020). The annual output of silver in 2020 can be more than 80 tons (including) for new applicants, and more than 40 tons (including) for new applicants in the western region. The export performance shall be subject to customs statistics, and the output shall be based on the output data provided by the National Bureau of Statistics or the domestic sales quantity reviewed by industry organizations.

IV. Relevant examination and declaration procedures
Enterprises that meet the declaration requirements of these provisions shall apply to the commerce departments of their provinces, autonomous regions, municipalities directly under the Central Government, cities separately listed on the State plan and Xinjiang production and Construction Corps (hereinafter referred to as provincial commerce departments). The competent department of commerce at the provincial level shall collect the application enterprises in their respective administrative regions and send the list of enterprises and application materials in their respective administrative regions to the Ministry of Commerce before November 15, 2021. The central enterprise shall directly submit the application and related materials (electronic version) to the Ministry of Commerce.

The Ministry of Commerce shall examine and approve the applicant enterprises. The list of enterprises that have passed the preliminary examination will be publicized on the website of the Ministry of Commerce for a period of 7 days. During the publicity period, if you have any objection to the publicity list, please submit an application for public objection to the Ministry of Commerce (Department of Foreign Trade). After receiving the application, the Ministry of Commerce (Department of Foreign Trade) will reply to the dissenting party within 7 working days. If there is no objection at the expiration of the 7-day publicity period, the Ministry of Commerce will put on record and publish the list of qualified enterprises to the public.
V. submission materials
When submitting an application, a state-owned trade declaration enterprise for the export of tungsten, antimony and silver must submit the following materials:
(1) an official letter signed by the legal representative of the applying enterprise and affixed with the official seal of the enterprise promising to submit the materials truly and effectively.
(2) a copy of the business license of the enterprise as a legal person, the customs business unit code and the enterprise code of the enterprise applying for legal person.
(3) ISO9000 series quality system certification certificate and ISO14000 series environmental management system certification certificate.
(4) the relevant certificates for the timely and full payment of social insurance such as old-age pension, unemployment, medical care, industrial injury and childbirth from January to September 2021.
(5) the newly declared enterprises of tungsten and antimony shall provide the list of enterprises supplying and circulating the corresponding products for export from 2018 to 2020, the quantity supplied and the photocopies of the corresponding VAT invoices or the certificate of export goods as agents.
(6) the newly declared enterprises of silver export state trade shall provide the output certificate for 2020.
(7) Tungsten export state-owned trade declaration enterprises are also required to submit the following materials:
1. Proof of bank credit line.
2.OHSAS18001/ISO45001:2007 Occupational Health and Safety Management system Certification Certificate.
