Arizona Supreme Court Upholds Hermosa Aquifer Protection Permit

The Arizona Supreme Court has upheld the Aquifer Protection Permit (APP) for South32’s Hermosa project, closing all avenues of appeal. The ruling confirms ADEQ’s decision at every review level and clarifies that water quality compliance will be measured closer to the actual discharge point. Hermosa incorporates extensive water safeguards, including two treatment plants, a comprehensive monitoring program, and designs using 90% less water than other mines in the region. President Pat Risner said the decision underscores the project’s strong permitting foundation and compliance with Arizona’s stringent environmental standards.
