Recently, the China referee Writing Network released the judgment of the first instance of the Ningde era's lawsuit against Tafel's new energy patent infringement. the court held that Tafel's new energy constitutes an infringement on the patent right of utility models in the Ningde era. It should stop the infringement and compensate for losses in accordance with the law, and ordered it to compensate the Ningde era for more than 2330 million yuan, involving economic losses and related costs to stop the infringement. It is understood that in March 2020, Ningde Times sued Tafel New Energy to the Fujian Provincial higher people's Court for economic losses of 120 million yuan because it was found that Tafel New Energy violated the patent of its power battery explosion-proof technology.

In the public judgment, the court found that the patent on the "explosion-proof device" utility model of the power battery infringed by Tafel New Energy was authorized by the State intellectual property Office in 2016 by Ningde Times. The NCM100Ah power battery produced and sold by Tafel New Energy uses the above patented technology scheme, and Fuzhou Wanguo sells Great Wall Euler electric vehicles with this power battery as a part, which constitutes an infringement on the patent rights involved.

The judgment revealed that the total storage capacity of infringing battery products sold by Tafel New Energy exceeded that of 736MWh, according to data provided by the Ministry of Industry and Information Technology.

In addition to the above-mentioned patent infringement case of battery "explosion-proof devices", Battery Network noted that Ningde Times also filed four patent lawsuits against Tafel New Energy last year, involving 80 million yuan, which has been accepted by the Fuzhou Intermediate people's Court. At present, the China referee Writing Network has not yet published the final judgments of the remaining patent lawsuits.

The patent war for lithium battery is becoming more and more fierce! On July 21, a number of media reported that the Ningde era submitted an indictment against AVIC Lithium Electric Patent infringement case, and the case has been accepted. The patents involved in the case involve patents for inventions and utility models, and the batteries are suspected of infringing on tens of thousands of cars.

On August 2, CNAC Lithium Power issued another statement against the patent infringement case filed by Ningde Times, saying that it had received two "Civil Complaints" ((2021) Min 01 No. 1995 and 1996 at the beginning of the Republic of China) served by the Fuzhou Intermediate people's Court on the Ningde Times lawsuit company. At the same time, the company said that the company attaches great importance to the matter and will respond to the lawsuit in accordance with legal procedures and is not afraid of challenges.

According to the data released by the China Automotive Power Battery Industry Innovation Alliance, from January to July, a total of 53 power battery enterprises in China's new energy vehicle market were equipped with supporting vehicles, 4 fewer than the same period last year. Among them, the power battery loads of the top 3, top 5 and top 10 power battery companies are 45.9GWh, 53.7GWh and 58.5GWhh respectively, accounting for 72.0%, 84.2% and 91.7% of the total load, respectively. Among them, Ningde era ranked first in terms of installed capacity, AVIC Lithium Power ranked fourth, and Tafel New Energy ranked ninth.

Minsheng Securities expects that the power battery production capacity of the Ningde era will reach 200GWH by the end of this year, and the company has planned seven major production bases around the world, and has just thrown out 58.2 billion yuan to increase its planned production capacity of 137GWh.It is estimated that the company's production capacity will exceed 600GWhby 2025, and its position as the king of global power battery production capacity will be further strengthened.

In 2021, the actual production capacity of CNAC lithium power production, under construction and construction will exceed 100GWH, and the planned production capacity will reach 200GWh in 2022. During the 14th five-year Plan period, the company's planned production capacity exceeded 300GWh. Since the beginning of this year, the company's power battery expansion project has been settled and started continuously.

It can be seen that today, lithium battery giants are not only using production capacity to seize the market, but also through patent litigation to establish the voice of intellectual property rights in the industry, and strive to gain more initiative in the future competition.
